LCR Car Rental – Terms and Conditions of Rental

This document outlines the full terms and conditions of vehicle rental provided by LCR Car Rental (Pty) Ltd, a registered vehicle hire company in the Republic of South Africa. It replaces all previously issued agreements or templates and is enforceable upon signature of the Rental Agreement.

  1. DEFINITIONS
    Terms such as “Company”, “Renter”, “Driver”, “Vehicle”, “Rental Agreement”, “Rental Period”, and others used throughout this document hold meanings aligned with their conventional legal definitions and are consistent with South African law. The full clause definitions have been modernised, renamed, and simplified for clarity.
  2. RENTAL TERMS
    LCR Car Rental rents vehicles strictly under these Terms and Conditions. The Renter accepts liability for the Vehicle, including if someone else is driving. Vehicles may only be used within Cape Town and surrounding areas unless approved in writing. Taking a vehicle beyond 150km outside Cape Town without prior consent may result in forfeiture of both the rental and deposit, and the Renter will be liable for recovery costs.
  3. VEHICLE DELIVERY & INSPECTION
    Delivery occurs once the Renter or authorised driver takes possession of the Vehicle or keys. A full inspection is to be conducted jointly by both parties. In absence of a written note of existing damage signed by both parties, the Vehicle is deemed in good condition.
  4. VEHICLE USE & RESTRICTIONS
    Vehicles must be operated only by approved drivers and used legally and responsibly:
  • No transport of goods or passengers for reward
  • No towing without written permission
  • No border crossing without approval
  • No use in high-risk zones (e.g., unrest areas)
  • Must be locked and secured when not in use
  • Renter is liable for replacement keys
  • Title of the Vehicle remains with LCR at all times
  1. RETURN OF VEHICLE
    Renter must return the Vehicle on the agreed date, time, and location. Unauthorised extensions are considered unlawful possession. LCR may repossess the Vehicle and charge the Renter for legal fees, recovery costs, and lost income. A delay may invalidate any waiver/PAI options and result in the Vehicle being reported stolen.
  2. TERMINATION BY LCR
    LCR reserves the right to cancel this agreement at any time, with or without notice, for any reason. The Vehicle must be returned immediately on request. Recovery costs for failure to do so will be billed to the Renter.
  3. RENTER/DRIVER RESPONSIBILITIES
  • Only drivers listed on the agreement may drive
  • Minimum age: 20 years
  • Must hold a valid driver’s license and not drive under influence
  • Renter is liable for any use outside of these terms
  • If renting on behalf of a business, the signatory must be duly authorised
  1. RATES, FEES, AND PENALTIES
  • Rates are detailed in the Rental Agreement
  • Additional charges may include: delivery/collection fees, excess kilometres, fines, insurance, admin fees, etc.
  • Odometer tampering incurs 500km/day default billing
  • Renter is liable for all fines, penalties, and legal costs due to improper use
  • Young driver surcharges apply under 25 years of age
  1. PAYMENTS & DEPOSITS
  • Full payment and deposit due at vehicle handover
  • Final balance due at return, subject to inspection
  • Refund of deposits (if no damage) within 5 working days
  • Refunds processed via same method of payment
  • No refunds for early returns or late cancellations (<30 days)
  1. RISKS & DAMAGE LIABILITY
  • The Vehicle is rented at the Renter’s risk
  • Renter pays for all damage, including loss or theft, regardless of fault
  • Insurance excess and admin fee applies unless terms were breached
  • Damage in the following conditions may void waivers or increase liability:
    • No visible third-party impact
    • Accidents between 01:00 and 06:00
    • Speeding over 30km/h above the limit
    • Leaving the scene of an accident
  1. CONSEQUENTIAL DAMAGES
    Renter is liable for LCR’s loss of rental income if the Vehicle is inoperative, calculated up to 30 days at the daily rate.
  2. INCIDENT PROCEDURE
    In the event of damage, theft, or loss:
  • Notify LCR within 3 hours
  • Submit a completed claim form within 24 hours
  • Report to SAPS and obtain a case number
  • Cooperate with all investigations and claims
  • Do not admit liability or make third-party settlements
  1. INDEMNITY
    LCR, its employees, or representatives shall not be held liable for any:
  • Injuries, loss of life, or property damage
  • Malfunction or defects
  • Claims arising from installation or use of child seats or accessories
  • Incidents of negligence or gross negligence unless proven by law
  1. JOINT LIABILITY
    All signatories on the Rental Agreement are jointly and severally liable for any amount owed.
  2. GENERAL LEGAL TERMS
  • This document is the full and final agreement
  • Any part found invalid shall not void the rest
  • LCR may pursue legal action in any appropriate court
  • Renter consents to credit/criminal checks and record sharing
  • Certain vehicles may include GPS trackers; data may be used in legal disputes
  • The Rental Agreement is not subject to the Consumer Protection Act or National Credit Act
  • Notices may be delivered by email, post, or in person
  • Any updates or changes to addresses for notice must be in writing
