Term & Condition

2.1 All rentals are subject strictly to these Terms and Conditions.
2.2 The Renter accepts full liability for the Vehicle for the duration of the Rental Period,
irrespective of who is driving.
2.3 No variation of these Terms shall be valid unless reduced to writing and signed by an
authorised representative of LCR.

3.1 Vehicles may only be used within Cape Town and surrounding areas, unless prior
written consent is obtained.
3.2 Removal of the Vehicle more than 150 kilometres outside Cape Town without written
approval constitutes a material breach and may result in:

● Immediate termination of the rental
● Forfeiture of rental and deposit
● Liability for all recovery, legal, and loss-of-income costs

4.1 Delivery occurs when the Vehicle or keys are handed to the Renter or authorised Driver.
4.2 A joint inspection must be conducted at handover and return.
4.3 In the absence of a written inspection report signed by both parties, the Vehicle
shall be deemed to have been delivered in good order and condition

The Vehicle may not be used for:
● Transport of goods or passengers for reward
● Towing or pushing of any object without written permission
● Crossing national borders without approval
● Participation in racing, testing, or reckless driving
● Use in high-risk, unrest, or restricted areas

5.2 The Vehicle must be locked, secured, and safeguarded at all times.
5.3 The Renter is liable for lost or damaged keys, trackers, or accessories.
5.4 Ownership and title of the Vehicle remain vested in LCR at all times.

6.1 The Vehicle must be returned on the agreed date, time, and location.
6.2 Unauthorised extensions constitute unlawful possession.
6.3 LCR may repossess the Vehicle without notice and recover:

● Legal costs
● Recovery fees
● Loss of rental income

6.4 Late return may invalidate any waiver or insurance options and may result in the Vehicle
being reported stolen.

7.1 LCR reserves the right to terminate this Agreement for cause, including breach, misuse,
or risk exposure.
7.2 Where reasonable and practicable, notice will be provided.
7.3 Upon termination, the Vehicle must be returned immediately. Failure to comply
authorises recovery at the Renter’s cost.

Only authorised drivers may operate the Vehicle

● Minimum driver age: 20 years
● Valid driver’s license required at all times
● No driving under the influence of alcohol or substances
● Business renters warrant authority to bind the entity

The Renter remains liable for all actions of the Driver.

9.1 Rental rates are as per the Rental Agreement.
9.2 Additional charges may include:

● Delivery / collection
● Excess kilometres
● Administrative fees
● Insurance or waiver options
● Traffic fines and penalties

9.3 Odometer tampering results in default billing of 500 km per day.
9.4 Drivers under 25 years may incur a surcharge.

10.1 Full rental and deposit are payable prior to or at handover.
10.2 Final charges are determined upon return and inspection.
10.3 Deposits (if applicable) will be refunded within 5 business days, less any deductions.
10.4 No refunds for early returns or cancellations within 30 days of the booking.

11.1 The Vehicle is rented entirely at the Renter’s risk.
11.2 The Renter is liable for all damage, loss, or theft regardless of fault.
11.3 Insurance excess and admin fees apply unless waived and not breached.
11.4 Waivers may be void where:

● No third-party impact exists
● Incident occurs between 01:00–06:00
● Speed exceeds legal limit by 30km/h
● Accident scene is abandoned

The Renter is liable for loss of rental income while the Vehicle is unavailable, calculated for
up to 30 days at the prevailing daily rate.

In the event of damage, loss, or theft, the Renter must:

● Notify LCR within 3 hours
● Submit documentation within 24 hours
● Report to SAPS and obtain a case number
● Cooperate fully with investigations
● Not admit liability or settle claims

To the maximum extent permitted by law, the Renter indemnifies LCR against all claims,
losses, or damages arising from:

● Injury or death
● Property damage
● Vehicle defects or malfunction
● Use of child seats or accessories

All persons signing the Rental Agreement are jointly and severally liable for all obligations and amounts owed.

16.1 This document constitutes the entire agreement.
16.2 If any provision is invalid, the remainder remains enforceable.
16.3 This Agreement is governed by the laws of the Republic of South Africa.
16.4 Jurisdiction lies with courts in the Western Cape.
16.5 To the extent permitted by law, including the Consumer Protection Act, these Terms
apply in full.
16.6 The Renter consents to credit, criminal, and verification checks.
16.7 Vehicles may contain GPS tracking devices for security and legal purposes.
16.8 Notices may be delivered by email, post, or hand delivery.
